DMCA Policy

Milk Punch is committed to respecting the intellectual property rights of others. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and expect our users to do the same. This policy outlines the procedures for reporting alleged copyright infringement and for responding to such notices.

Filing a DMCA Infringement Notice

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Milk Punch service, please notify our Designated Copyright Agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing and where it is located on the Milk Punch service, including, at a minimum, the URL(s) of the specific pages where the allegedly infringing material can be found.
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted on Milk Punch was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with our Designated Copyright Agent. For your counter-notification to be valid under the DMCA, you must provide the following information in writing:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Milk Punch may be found, and that you will accept service of process from the person who provided the initial DMCA notification or an agent of such person.
